This website is operated by Leon Baker Jewellers. Throughout the site, the terms "we", "us" and "our" refer to Leon Baker Jewellers. Leon Baker Jewellers offers this website, including all information, tools and services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependants to use this site.

You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse Service to anyone for any reason at any time.

Credit card information is always encrypted during transfer over networks.

SECTION 5 – PRODUCTS OR SERVICES & RETURNS

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis.

 

Return Policy:

We have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You'll also need the receipt or proof of purchase.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 7 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice.

In addition to other prohibitions, you are prohibited from using the site or its content:

SECTION 13 – LIMITATION OF LIABILITY

To the extent permitted by law, Leon Baker Jewellers shall not be liable for any indirect, incidental, special, or consequential loss or damage (including loss of profit, revenue or data) arising out of or in connection with your purchase or use of our website or products.

Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty, or other condition implied or imposed by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) which cannot be lawfully excluded.

Where permitted under section 64A of the Australian Consumer Law, our liability is limited at our option, to:

     in the case of goods, the replacement or repair of the goods, or the cost of such replacement or repair;

     in the case of services, the resupply of the services, or the cost of resupplying the services.

Our total liability for any claim arising from your purchase shall not exceed the purchase price of the item in question.

 

SECTION 14 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless Leon Baker Jewellers and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable solicitors' fees, made by any third-party due to or arising out of your breach of these Terms of Service.

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services.

SECTION 17 – ENTIRE AGREEMENT

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service.

SECTION 18 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.

PART B — In-Store Service & Repairs Terms


1. Scope & Acceptance

These terms apply to all in-store services, including but not limited to cleaning, polishing, resizing, repairs, re-tipping, re-setting, rhodium plating, engraving, custom design and manufacture, valuations, and inspections.

By leaving an item with Leon Baker Jewellers ("we", "us", "our"), approving a quote, or accepting a job packet, you acknowledge and agree to these Terms of Service.

These Terms are displayed in-store, printed on job packets, and published online for public reference. Proceeding with a job implies acceptance.2. Quotes & Authorisation

Quotes—whether verbal or written—are valid for 30 days from the date issued and are based on the visible condition of the item upon intake.

If, during work, additional damage, wear, or concealed faults are discovered, we will contact you for approval before proceeding.

If the work is urgent and failure to act could cause further damage (for example, loose stones or broken claws), we may, in our discretion, carry out the essential repair at a reasonable cost to protect your property.

All quotes exclude subsequent loss, wear, or age-related degradation unless stated otherwise.

3. Weight & Cleaning Variance

Jewellery cleaning and polishing often remove microscopic layers of metal or surface dirt and oxidation.

A weight difference of approximately 0.1 – 0.5 grams may occur after cleaning or polishing; this is a normal result of the process and does not indicate loss of material or negligence.

Where rhodium plating or surface finishing is involved, minor variations in colour or texture are also considered normal.

4. Customer Responsibilities

Customers must:

     Provide accurate contact details (address, phone, and email).

     Inform us of any prior repairs, gemstone treatments, or weaknesses in the item.

     Maintain insurance coverage for their property while it is in our possession; we are not an insurer.

     Inspect their items at collection and raise any concerns immediately.

Failure to collect or inspect promptly may limit our ability to address later concerns.

5. Collection, Storage & Abandoned Property

Customers are notified when jobs are complete. Items must be collected within 90 days of notice.

After 90 days, a storage fee of 10% of the total job value per month (or part thereof) will be added.

We hold a general lien over any item until all amounts owed—including repair charges and storage fees—are paid in full.

If an item remains uncollected for more than 6 months, and reasonable attempts to contact you (phone, email, letter, or newspaper notice) have failed, the item may be sold, recycled, or otherwise disposed of in accordance with the Australian Consumer Law and the Second-hand Dealers and Pawnbrokers Act (WA).

Any proceeds after cost recovery will be held for 12 months for the lawful owner.

6. Payments & Title

Full payment is required before collection unless otherwise agreed in writing.

We accept cash, EFTPOS, credit card, and cleared bank transfer.

Title to any remade, altered, or manufactured item remains the property of Leon Baker Jewellers until all amounts due are paid in full.

Where payment is not received, we reserve the right to retain the item or dispose of it under applicable law.

 

7. Workmanship Warranty (12 Months)

Our workmanship is warranted for 12 months from the collection date.

This warranty covers defects in the workmanship of the repair or manufacture.

It does not cover:

     Normal wear and tear.

     Accidental damage, impact, or misuse.

     Chemical or salt-water exposure.

     Third-party alterations or repairs.

     Failure to maintain regular inspections or follow our care advice.

Our liability under this warranty is limited to re-work or re-repair of the affected item, or if impractical, a refund of the service cost.

Nothing in this clause limits your statutory rights under the ACL.

8. Complimentary Ring Resizing (Initial Purchase)

For rings purchased from Leon Baker Jewellers, we offer one complimentary resizing service, subject to the following conditions:

•   Complimentary resizing is available within three (3) months from the original purchase date.

•   Resizing is limited to up to three (3) sizes larger or smaller from the original size.

•   This service is provided in-store only and applies to the original purchaser.

•   The ring must be structurally suitable for resizing as determined by our jewellers.

•   The offer excludes rings that cannot be resized due to design, gemstone setting, metal type, previous resizing, or risk of damage.

•   This service does not apply to rings that have been altered or repaired by a third party.

 

Where a ring is deemed unsuitable for complimentary resizing, resizing may still be offered at standard repair rates.

This complimentary service is provided in addition to, and does not limit, your rights under the Australian Consumer Law.

 

8. Stones, Settings & Replacement

We inspect and record stones before and after repair.

If a stone falls out after collection, replacement will be at the customer's cost unless it is clearly due to a workmanship fault.

Stone loss caused by age, wear, impact, metal fatigue, or pre-existing weakness is not covered.

If replacement is necessary and an exact match is unavailable, we will use a comparable stone of equivalent value.

9. Customer-Supplied Materials

We take all reasonable care with customer-supplied gemstones and metals.

However, due to the unpredictable nature of natural gemstones and alloys, we cannot guarantee against cracking, chipping, or distortion caused by inherent defects or heat sensitivity.

Customers should ensure their items are covered by their own insurance prior to work commencement.

 

10. Custom Designs, Deposits & Intellectual Property

All custom design and manufacture jobs require a non-refundable deposit of at least 50% before work commences.

Design sketches, CAD renders, and models remain the intellectual property of Leon Baker Jewellers until full payment is received.

Small variations may occur due to gemstone characteristics or manufacturing tolerances.

Design Process:

1.     Consultation & quotation.

2.     $200 design fee (credited if proceeding) and CAD approval.

– Includes one reasonable revision; further major changes $100 each.

3.     Manufacture after written approval and deposit.

4.     Final inspection and collection.

11. Leon Baker-Made Jewellery — Lifetime Care Program

     Free professional cleaning for life on all Leon Baker-made jewellery.

     One complimentary annual clean and inspection in the first year.

     To maintain warranty validity, pieces should be inspected at least once every 12 months to ensure claws, settings, and structure remain secure.

     Missed inspections may void the lifetime guarantee.

Our staff will stamp or record inspections to track compliance.

12. Privacy, Security & Records

All personal information is handled under the Australian Privacy Principles.

CCTV is in operation for the security of customers, staff, and property.

We may photograph or measure your item upon intake and after completion as a condition record for both quality control and insurance purposes.

 

13. Disputes & Consumer Rights

If you have any concern about our service, please contact store management immediately so we can resolve the issue promptly and fairly.

These Terms are governed by the laws of Western Australia.

Nothing in these Terms excludes or limits your rights under the Australian Consumer Law (ACL).

Where a remedy is required under the ACL, it will be provided in accordance with statutory obligations.

 

 

PART C — Watch Repair Warranties & Guarantees

Everything you need to know about our warranty, water-resistance testing and what’s covered.

At Leon Baker Jewellers we stand behind every watch service we perform. This section sets out the warranties and guarantees that apply to our watch services — including battery replacements and water-resistance pressure testing — along with simple, plain-language guidance on how to keep your watch performing at its best.

14. Watch Battery Warranty

Every watch battery we fit comes with a 12-month workmanship warranty. Here’s how it works:

What’s covered

•     12 months free replacement. If your new battery fails within 12 months of fitting, we’ll replace it at no charge.

•     Workmanship. Our fitting service, including greasing seals and reseating the caseback where appropriate, is covered.

What’s not covered

•     Damage from water, moisture or condensation entering the watch.

•     Watches that stop or lose time due to a fault in the movement, not the battery.

•     Any damage caused by drops, knocks, chemical exposure or third-party work after the service.

•     Pre-existing faults that were not apparent during inspection.

If your watch stops or loses time and the battery is still good, we’re happy to provide a repair quote — any further work would be at the customer’s cost.

15. Water Resistance & Pressure Testing

A standard battery replacement does not include a water-resistance guarantee. For customers who want certainty that their watch will handle water, we offer in-house pressure testing using professional Witschi test equipment.

Water resistance is only guaranteed if you opt for one of our pressure tests (A1 or A2) — not with a standard battery service.

Our pressure testing services

A1 — Standard Pressure Test (industry standard)

Our A1 test uses pressurised air to check the integrity of the case seals — this is the industry-standard pressure test and is suitable for verifying water resistance on most watches. It’s a dry test, so there’s no risk of water entering the watch during testing.

A2 — Multi-Level Pressure Test (up to 10 bar, with printed results)

Our A2 test is a more thorough dry pressure test that progressively checks the watch at multiple pressure levels up to 10 bar. It produces a detailed printed test result that we staple to your Certificate of Guarantee — giving you verified evidence of exactly how your watch performed under pressure. Recommended for divers, swimmers, and anyone who wants documented proof of their watch’s condition.

16. The 12-Month Water-Resistance Guarantee

When you pay for an A1 or A2 pressure test, we issue a Certificate of Guarantee valid for 12 months from the date of test. A copy of the test result is stapled to your certificate for your records.

What the guarantee covers (for 12 months)

•     Hand washing and incidental splashes of water.

•     Everyday wear within the watch’s marked water-resistance rating.

•     Swimming — only if the watch is marked water-resistant to a depth that allows it, and strictly within the manufacturer’s stated specification.

What the guarantee does not cover

•     Showering, saunas, or hot tubs. Heat and rapid pressure changes break seals, even on watches rated for swimming.

•     Any use beyond the watch’s manufacturer water-resistance rating (for example, diving in a watch rated only for splashes).

•     Damage caused by knocks, drops, or the crown being left unscrewed or pulled out.

•     Chemical exposure — perfumes, cleaning products, sunscreens, chlorine, and saltwater.

•     Any third-party servicing or opening of the watch after the test. Once the case is opened by anyone else, the guarantee is void.

17. Your Watch, Your Responsibility

Watches are mechanical and water-resistance relies on seals, gaskets and crown alignment that wear out over time. Age, knocks, heat, chemicals, and old batteries can all compromise these seals without any visible sign. Once water gets inside a watch, it can damage the movement, dial, hands and battery contacts — often within hours.

Practical advice

•     Do not shower with your watch. This is the single most common cause of water damage we see. Even a watch rated for swimming can fail in a shower due to heat and steam.

•     Check your watch’s marking. Water-resistance ratings vary significantly. A watch marked “30m” or “3 ATM” is really only splash resistant — not suitable for swimming.

•     Have it tested before a big trip. If you’re heading to the beach or pool, book a pressure test beforehand to catch any seal wear early.

•     Get the seals refreshed periodically. Water-resistance performance deteriorates over time — manufacturers typically recommend re-testing every 12–18 months for watches used in water.

•     Always make sure the crown is pushed in or screwed down fully. A watch with the crown pulled out has no water resistance at all.

18. Watch Service — Frequently Asked Questions

Why doesn’t a battery change include a water-resistance guarantee?

Opening the caseback to change a battery disturbs the seals. We always grease and reseat them, but we have no way of knowing whether the seals themselves are worn, cracked, or out of spec without a proper pressure test. Guaranteeing water resistance without testing would be misleading.

Do I need a pressure test if I don’t swim with my watch?

Not necessarily. If you never expose your watch to water beyond the occasional hand wash, a standard battery change is usually sufficient. However, if your watch is likely to see any water contact — including showering — we strongly recommend a pressure test.

What happens if my watch fails the pressure test?

We’ll let you know immediately and can quote you for seal replacement or further work to restore water resistance. Failing the test means the guarantee cannot be issued, but it also means we’ve caught a problem before it caused damage.

Does the guarantee cover my watch if I wear it swimming in the ocean?

Only if the watch is specifically marked by the manufacturer as suitable for salt-water use and the rating is within specification. Salt water is especially corrosive and, even with a pressure test, we advise rinsing the watch in fresh water after any salt-water exposure.

What if my watch was working fine before the battery change but now it’s not?

Bring it back in — we’ll have a look free of charge. If the fault relates to our work on the battery, we’ll resolve it under warranty. If the fault is unrelated (for example, a movement issue that coincidentally surfaced after the service), we’ll provide a separate quote for repair.
